To qualify, applicants must demonstrate exceptional talent through consistent national or international recognition. Eligibility requires meeting at least three of the ten specified criteria or showcasing a single, exceptional accomplishment. Examples of one-time achievements that meet the standard include winning prestigious awards such as an Oscar, a Nobel Prize, an Olympic medal, or similar honors.
To prove that you possess extraordinary abilities, you must provide evidence for at least 3 out of the 10 listed qualifications, unless you hold an internationally recognized award or achievement. These qualifications should demonstrate consistent recognition on a national or international level.

- Proof of earning a significantly high salary or compensation compared to peers in your profession.
- You need to have international recognition for exceptional achievements in your academic discipline.
- You should possess a minimum of 3 years of experience in teaching or conducting research in your field of expertise.
- You must have a job offer from a U.S. employer for a teaching or research role.
To qualify for an EB1C visa, the following conditions must be satisfied:
- The foreign worker must have been employed in a managerial or executive role outside the United States for at least one of the three years immediately before applying.
- The worker must be transferred to a U.S.-based company to take up a managerial or executive position.
- The U.S. company must have a legitimate relationship with the foreign company, such as being a branch, subsidiary, affiliate, or parent organization.
- The worker must enter the United States to continue working in a managerial or executive capacity for the same employer or an affiliated entity.
Additionally, the foreign worker must comply with U.S. immigration laws and regulations, including possessing a valid passport and a legitimate job offer from a U.S. employer.
