Position Evaluations (PE)
Position evaluations are customized evaluations from experts regarding whether a Specialty occupation position meet USCIS H-1B regulations or Visa requirements and are regularly used in:
1. Initial H-1B petitions
2. In response to a Request for Evidence (RFE) or
3. In response to a denial

Each position duty must be listed along with an explanation of how the position meets specialty occupation requirements. In some cases, the expert may discuss the beneficiary’s qualifications. Employers should provide a list of duties, roles, responsibilities, and education and experience requirements necessary to perform the job. Job descriptions need to be as specific as possible and very closely related to the Standard Occupational Classification (SOC) code that is used on the petition’s labor condition application. We also provide CPT analysis and CPT Position evaluations.

We understand that the evaluation criteria for all National Interest Waiver (NIW) cases follow a three-point test:
- The foreign national’s proposed endeavor must demonstrate substantial merit and national importance.
- The individual must be well-positioned to advance the proposed endeavor effectively.
- It should be shown that waiving the job offer and labor certification requirements would, on balance, benefit the United States.
Additionally, the individual must either demonstrate “Exceptional Ability” in their field or hold an advanced degree (or a bachelor’s degree with at least five years of work experience in the relevant field). To establish exceptional ability, the applicant must meet at least three of the following criteria:
- A degree, diploma, certificate, or comparable award from a recognized institution in a field related to their exceptional ability.
- Documentation of at least 10 years of full-time experience in their occupation.
- A valid license to practice their profession or occupation.
- Evidence of commanding a salary or other remuneration that highlights their exceptional ability.
- Membership in professional associations relevant to their field.
- Recognition of achievements and significant contributions to their industry or field, supported by letters from peers, government agencies, or professional organizations, or other comparable evidence.
To proceed with this NIW case, please provide the following supporting documents:
- A detailed description of the beneficiary’s proposed endeavor.
- Work experience letters that are currently available.
- The most recent version of the beneficiary’s resume.
- Copies of all educational credentials.
- Recommendation letters (those currently available).
- The petition support letter.
- Any additional documents submitted or planned for submission to USCIS.
- A copy of the RFE (Request for Evidence), if one was issued by USCIS for the initial petition.
